These Terms of Use govern access to and use of the Lux Carbon website, marketplace, seller tools, subscription services and related features. By accessing or using Lux Carbon, you agree to these Terms.
If you do not agree with these Terms, you should not use the platform.
1. About Lux Carbon
Lux Carbon is an online marketplace and SaaS platform focused on carbon fiber automotive parts, body kits, exterior upgrades and related automotive products offered by independent sellers.
Lux Carbon provides digital infrastructure that allows independent sellers, suppliers and manufacturers to publish listings, promote products, manage marketplace content and connect with prospective customers.
Lux Carbon does not manufacture, own, stock, inspect, import, distribute or directly sell products listed by independent sellers unless explicitly stated otherwise.
2. Independent Marketplace
Products displayed on Lux Carbon may be offered by independent third-party sellers.
The seller is responsible for the product and for all matters relating to the sale, including:
- product availability;
- pricing;
- product descriptions and specifications;
- vehicle compatibility and fitment;
- product condition;
- order acceptance and processing;
- payment arrangements;
- shipping and delivery;
- customs, duties and import requirements;
- warranties;
- returns and refunds;
- after-sales support.
Unless expressly stated otherwise, any transaction is entered into directly between the buyer and the independent seller.
Lux Carbon is not a party to that transaction and does not act as the seller, buyer, manufacturer, distributor, importer, freight provider, payment guarantor or product warranty provider.
3. Product Information
Product information displayed on the marketplace may be supplied by sellers, manufacturers, distributors or other third-party sources.
Lux Carbon does not guarantee that product descriptions, photographs, specifications, prices, availability, compatibility or other listing information are complete, current or error-free.
Buyers should verify all important information directly with the seller before purchasing or installing any product.
4. Vehicle Fitment and Compatibility
Automotive products may differ depending on model year, trim level, engine, body style, market specification and previous vehicle modifications.
Any vehicle compatibility, model reference or fitment information displayed on Lux Carbon is provided for general guidance only unless expressly confirmed by the seller.
The buyer is responsible for verifying compatibility before purchasing, installing or modifying a product.
Lux Carbon is not responsible for incorrect fitment, installation costs, modification costs, vehicle damage or losses resulting from the purchase or installation of an incompatible product.
5. Orders and Payments
Where an order, inquiry or request is submitted through Lux Carbon, the information may be forwarded to or made available to the relevant independent seller.
The seller may contact the customer directly regarding availability, price, payment, delivery or other transaction details.
A listing, inquiry or order submission does not necessarily constitute acceptance of an order by the seller.
Lux Carbon does not guarantee that any listed product remains available or that a seller will accept a particular order.
6. Shipping, Customs and Delivery
Shipping arrangements are the responsibility of the applicable seller unless explicitly stated otherwise.
Estimated delivery times are estimates only and may be affected by carriers, customs authorities, weather, supply delays or other circumstances outside the control of Lux Carbon.
International buyers may be responsible for customs duties, taxes, import charges, brokerage fees or other local charges.
Lux Carbon is not responsible for carrier delays, customs delays, lost shipments, shipping damage or other delivery-related matters arising from a transaction between a buyer and seller.
7. Returns, Refunds and Warranties
Return, refund and warranty conditions may vary between independent sellers.
Customers should review the seller's applicable terms before completing a purchase.
Any statutory consumer rights that cannot legally be excluded remain unaffected.
Lux Carbon does not independently provide a product warranty for products sold by third-party sellers unless explicitly stated otherwise.
8. Seller Accounts
Sellers using Lux Carbon are responsible for maintaining accurate account and business information.
Sellers must ensure that their listings comply with applicable laws and accurately represent the products being offered.
Sellers remain solely responsible for their products, customers, transactions, taxes, legal obligations and regulatory compliance.
9. Seller Subscriptions
Lux Carbon may offer paid subscription plans that provide sellers with access to marketplace features, product listing capacity, promotional tools, visibility features or other platform functionality.
A subscription fee is a fee for access to Lux Carbon's digital platform and services. It is not a commission on product sales and does not make Lux Carbon a party to transactions between sellers and buyers.
Available features, listing limits, pricing and subscription conditions may vary depending on the selected plan.
10. Recurring Billing
Where a subscription is described as recurring, the subscription may renew automatically for successive billing periods until cancelled in accordance with the applicable subscription settings or cancellation procedure.
By purchasing a recurring subscription, the seller authorizes the applicable payment provider to charge the subscription fee for each billing period.
The seller is responsible for maintaining valid payment information.
11. Subscription Cancellation
A seller may cancel a subscription in accordance with the cancellation options made available by Lux Carbon.
Unless otherwise stated, cancellation stops future renewals and does not automatically entitle the seller to a refund for a billing period that has already started.
Any mandatory refund or withdrawal rights provided by applicable law remain unaffected.
12. Subscription Changes
Lux Carbon may modify subscription plans, features, limits or pricing.
Where required by applicable law or payment-provider rules, appropriate notice will be provided before material changes affect an existing recurring subscription.
13. No Guarantee of Sales or Traffic
Seller subscriptions, featured listings, advertising tools or marketplace visibility do not guarantee sales, inquiries, search engine rankings, website traffic, customer engagement or commercial results.
Lux Carbon does not guarantee any minimum number of visitors, leads, orders or transactions.
14. Marketplace Availability
Lux Carbon may modify, update, restrict, suspend or discontinue any part of the platform where reasonably necessary for maintenance, security, legal compliance, technical development or business operations.
Continuous and uninterrupted availability of the platform is not guaranteed.
15. Seller Content and Listings
Sellers remain responsible for all text, photographs, trademarks, product information and other materials they submit to Lux Carbon.
By submitting content to the platform, the seller grants Lux Carbon a non-exclusive license to display, reproduce, resize, format, distribute and promote that content for the purpose of operating and marketing the marketplace.
Sellers must not upload content that infringes intellectual property rights or other rights of third parties.
16. Prohibited Use
Users must not use Lux Carbon to:
- publish false or misleading listings;
- offer unlawful or prohibited products;
- infringe intellectual property rights;
- introduce malware, malicious code or harmful scripts;
- attempt unauthorized access to the platform;
- scrape, overload or disrupt the platform unlawfully;
- impersonate another person or business;
- use the platform for fraudulent activity.
17. Account Suspension and Removal
Lux Carbon may restrict, suspend or terminate access to seller or user accounts where there is suspected fraud, misuse, non-payment, security risk, legal violation, repeated customer complaints or breach of these Terms.
Lux Carbon may remove or restrict listings that are misleading, unlawful, inappropriate, technically harmful or inconsistent with marketplace requirements.
18. Third-Party Services
Lux Carbon may contain links to, or integrations with, third-party websites, payment providers, shipping companies and other external services.
Those services operate independently and may be subject to their own terms and privacy policies.
Lux Carbon is not responsible for the availability, security, content or actions of independent third-party services.
19. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Lux Carbon and its marketplace services are provided on an "as is" and "as available" basis.
Lux Carbon makes no guarantee regarding the accuracy, reliability, availability, suitability, quality, safety or legality of products or listings supplied by independent sellers.
Lux Carbon does not guarantee the conduct, identity, reliability or performance of any buyer, seller, manufacturer, supplier, carrier or other third party.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Lux Carbon shall not be liable for indirect, incidental, special, consequential or commercial losses arising from use of the platform or from a transaction between independent marketplace users.
This includes, without limitation, loss arising from:
- incorrect or inaccurate product information;
- product defects;
- incorrect vehicle fitment;
- installation or modification of products;
- seller or buyer conduct;
- payment disputes;
- shipping or customs delays;
- loss or damage during delivery;
- website interruption;
- loss of data;
- loss of revenue, profit, opportunity or business.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
21. Indemnification
To the extent permitted by applicable law, sellers agree to be responsible for claims, losses, liabilities and reasonable costs arising from their listings, products, transactions, violation of applicable law, infringement of third-party rights or breach of these Terms.
22. Intellectual Property
The Lux Carbon name, platform design, software, branding, logos and original platform content are protected by applicable intellectual property laws.
No rights are granted to reproduce, copy, modify or commercially exploit Lux Carbon intellectual property except where expressly permitted.
23. Changes to These Terms
Lux Carbon may update these Terms from time to time to reflect changes to the platform, services, subscriptions, legal requirements or marketplace operations.
The latest version published on the website will apply from its stated effective date.
24. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
