Buyer Returns

Information about returns, cancellations, refunds and statutory consumer rights when purchasing products from independent sellers on Lux Carbon.

Lux Carbon is an online marketplace connecting buyers with independent sellers. Unless expressly stated otherwise, the applicable independent seller is the seller of the product and is responsible for returns, refunds, legal guarantees and other consumer obligations arising from the sale.

Nothing in this policy limits any mandatory consumer rights available under applicable European Union or national law.

14-Day Right of Withdrawal

If you are a consumer purchasing goods online from a professional seller (a trader), EU consumer law generally gives you the right to withdraw from the purchase within 14 days without giving a reason.

For goods, the withdrawal period normally expires 14 days after the day on which you, or a third party designated by you other than the carrier, receive the goods.

If multiple goods from one order are delivered separately, the applicable withdrawal period may run from receipt of the last item where required by law.

To exercise the right of withdrawal, you must inform the applicable seller of your decision before the withdrawal period expires. A clear statement by email or another communication method accepted by the seller is sufficient unless applicable law requires otherwise.

Returning Goods After Withdrawal

After notifying the seller that you are withdrawing from the purchase, you must normally return or send the goods back without undue delay and no later than 14 days after communicating your decision to withdraw.

For a standard return under the 14-day right of withdrawal, the buyer normally bears the direct cost of returning the goods if the seller informed the buyer of this obligation before the purchase.

If the seller agreed to pay the return cost, or failed to provide legally required information about return costs before the purchase, different rules may apply.

Carbon fiber body parts and other large automotive components can be expensive to return. Buyers should review the seller's delivery and return information before placing an order.

Refunds After Withdrawal

Where the statutory right of withdrawal applies, the seller must normally reimburse the payments received from the consumer, including the cost of the least expensive standard delivery option offered for the original order.

Additional delivery charges resulting from the buyer choosing a more expensive delivery method, such as express shipping, do not normally have to be refunded.

The reimbursement must generally be made without undue delay and no later than 14 days after the seller is informed of the withdrawal.

The seller may withhold reimbursement until the goods have been received back, or until the buyer provides evidence that the goods have been sent back, whichever occurs first.

Unless otherwise agreed, reimbursement should normally be made using the same payment method used for the original transaction.

Condition of Returned Goods

Buyers may inspect a product to the extent reasonably necessary to establish its nature, characteristics and functioning, similar to the inspection that would normally be possible in a physical shop.

A buyer may be responsible for diminished value caused by handling or using the product beyond what is reasonably necessary for that inspection.

Products should therefore be returned carefully and, where reasonably possible, with their supplied components, accessories and packaging.

Custom and Personalised Products

The 14-day right of withdrawal does not apply in all circumstances.

In particular, the statutory withdrawal right may not apply to goods made specifically to the consumer's specifications or goods that are clearly personalised.

This can be relevant to automotive parts that are individually manufactured, modified, finished or personalised according to a buyer's specific requirements.

A product is not automatically excluded from the right of withdrawal merely because it is ordered online or produced after an order is placed. The statutory exception must actually apply to the particular product and transaction.

Other exceptions provided by applicable consumer law may also apply.

Faulty, Damaged or Incorrect Goods

The 14-day withdrawal right is separate from your rights when a product is faulty, damaged, incorrectly supplied or otherwise does not conform to the sales contract.

Where EU consumer protection rules apply, the professional seller is responsible for bringing non-conforming goods into conformity.

Depending on the circumstances, the consumer may be entitled to repair or replacement free of charge. If an appropriate repair or replacement cannot be provided as required by law, the consumer may be entitled to a proportionate price reduction or termination of the contract and a refund.

The seller is responsible for the costs required to return defective goods where those statutory rights apply.

EU Legal Guarantee

Consumers purchasing goods from professional sellers in the EU generally benefit from a minimum two-year legal guarantee for goods that are faulty or do not conform to the sales contract.

The legal guarantee applies against the seller and is separate from any additional commercial warranty offered by a manufacturer or seller.

National consumer laws may provide additional or stronger protection.

Professional and Private Sellers

EU consumer rights depend on the status of the seller.

The statutory 14-day withdrawal right and the EU legal guarantee rules described above generally apply when a consumer purchases from a professional seller acting as a trader.

Purchases from private individuals are generally not covered by the same EU consumer protection rules. Any rights relating to such a transaction may instead depend on the seller's terms and applicable national law.

How to Request a Return

Return requests relating to a marketplace product should be addressed to the seller responsible for that product.

  1. Contact the applicable seller as soon as possible.
  2. Provide your order or transaction reference.
  3. Identify the product concerned.
  4. Explain whether you are exercising a withdrawal right or reporting a faulty, damaged or incorrect product.
  5. Follow the seller's reasonable return instructions.
  6. Keep proof of shipment when returning a product.

Do not send a product to Lux Carbon unless Lux Carbon has expressly instructed you to do so. Products sold by independent sellers must normally be returned to the applicable seller or to the return address designated by that seller.

Marketplace Responsibility

Lux Carbon provides the marketplace infrastructure through which independent sellers can list products and communicate with buyers.

Unless expressly stated otherwise, Lux Carbon is not the seller of products listed by independent sellers and does not replace the seller's statutory obligations relating to returns, refunds, conformity, warranties or consumer remedies.

Lux Carbon may assist buyers and sellers with communication concerning a marketplace transaction, but the applicable seller remains responsible for resolving return and refund requests relating to that seller's products.

Nothing in this policy excludes any obligation or liability that Lux Carbon itself cannot lawfully exclude under applicable law.

National Consumer Rights

EU consumer legislation establishes minimum protections, but national laws may provide additional rights or longer protection periods.

Where mandatory national consumer law provides greater protection than this policy, the applicable mandatory law prevails.
