Seller Terms

These Seller Terms set out the rules and responsibilities that apply to independent sellers listing products and operating a store on the Lux Carbon marketplace.

Lux Carbon provides marketplace infrastructure that allows independent sellers to publish automotive products, operate a seller profile and connect with potential buyers.

By creating or operating a seller account, publishing products or using seller services on Lux Carbon, you agree to comply with these Seller Terms, the applicable marketplace policies and all laws and regulations relevant to your products and business.

Sellers remain independently responsible for their products, listings, transactions and obligations to customers.

Seller Status and Eligibility

Sellers must provide accurate information about their identity and commercial status. A seller must not falsely represent itself as a company, professional trader, manufacturer, authorised distributor or private seller.

Lux Carbon may request information reasonably necessary to verify a seller before or during use of the marketplace.

This may include:

  • Legal or trading name.
  • Business address.
  • Email address and telephone number.
  • Company or trade registration information where applicable.
  • VAT or tax information where applicable.
  • Identity or business verification documents.
  • Payment account information where relevant.
  • Manufacturer, importer or responsible-person information where legally required.

Sellers must keep their account and business information accurate and reasonably up to date.

Seller Subscription

Access to product listing and seller services on Lux Carbon may be provided through a paid marketplace subscription.

Subscription pricing is agreed individually with each seller and may depend on factors including catalog size, number of products, update requirements, marketplace services and other agreed commercial conditions.

The applicable price, billing period, scope of service and payment terms are confirmed separately with the seller.

A subscription provides access to agreed marketplace services. It does not guarantee a particular level of traffic, inquiries, product visibility, leads or sales.

Lux Carbon may suspend seller services where an agreed subscription payment remains overdue, subject to the applicable agreement and law.

Seller Account

The seller is responsible for activity carried out through its seller account and for maintaining the security of account credentials.

Seller accounts must not be transferred, sold or provided to another business without prior approval from Lux Carbon.

Sellers must notify Lux Carbon if they become aware of unauthorized access, compromised credentials or misuse of their account.

Product Listings

Sellers are responsible for all information supplied for their product listings.

Listings must be accurate and must not intentionally mislead buyers regarding:

  • Product identity.
  • Manufacturer or brand.
  • Part number or SKU.
  • Product condition.
  • Materials and specifications.
  • Vehicle compatibility and fitment.
  • Included components.
  • Availability and stock status.
  • Price and applicable charges.
  • Production or processing time.
  • Shipping conditions.
  • Warranty information.
  • Safety information where applicable.

Sellers must correct inaccurate information as soon as reasonably possible after becoming aware of it.

Lux Carbon may edit formatting, categorisation, technical presentation or other non-material elements of listings where reasonably necessary for marketplace operation, consistency or usability.

Prices and Availability

Sellers are responsible for maintaining accurate prices and availability information.

A seller must not intentionally advertise a misleading price, false discount, unavailable product or inaccurate stock quantity in order to attract customer inquiries.

Where final pricing depends on configuration, destination, production requirements or another legitimate factor, this must be communicated clearly to the buyer.

If information displayed on Lux Carbon becomes outdated, the seller remains responsible for providing the buyer with accurate information before completing the transaction.

Production and Lead Times

Many carbon fiber automotive products are manufactured or prepared after an order is placed and may not be immediately available for dispatch.

Sellers must provide buyers with realistic information about production, processing and estimated dispatch times.

Manufacturing or preparation of certain products may take up to three months.

Where an extended production period applies, the seller must clearly communicate or agree that timeframe with the buyer before the transaction is completed.

Sellers must distinguish production time from transportation time and must not represent a manufacturing lead time as if the product were already dispatched.

Orders and Customer Transactions

Unless expressly agreed otherwise, the independent seller is the party responsible for the commercial transaction relating to products offered through its store.

The seller is responsible for:

  • Confirming availability.
  • Confirming the final price.
  • Accepting or declining the order.
  • Providing payment instructions where applicable.
  • Receiving and confirming payment.
  • Producing or sourcing the product.
  • Fulfilling the order.
  • Arranging shipping.
  • Providing customer support.
  • Handling returns and refunds.
  • Providing applicable warranty remedies.

Lux Carbon provides marketplace technology and communication infrastructure and does not automatically become the seller or contractual supplier of products listed by independent sellers.

Payments

Where payment for a product is arranged directly between the seller and buyer, the seller is responsible for providing legitimate payment instructions and accurately recording the transaction.

Sellers must not use misleading payment requests, false invoices, fraudulent payment details or payment methods prohibited by applicable law.

Sellers are independently responsible for taxes, accounting, invoicing and other financial obligations arising from their sales.

Shipping and Delivery

Sellers are responsible for fulfilment and shipping arrangements for their products unless another arrangement has been expressly agreed.

Sellers must provide accurate information concerning:

  • Production and processing times.
  • Estimated dispatch times.
  • Available shipping methods.
  • Shipping charges.
  • Delivery restrictions.
  • Tracking information where available.
  • Customs or import arrangements where relevant.

A seller must promptly inform the buyer when it becomes aware of a material delay affecting an agreed production or delivery timeframe.

Returns, Refunds and Consumer Rights

Sellers are responsible for complying with mandatory consumer protection rules applicable to their transactions.

Where an EU consumer purchases from a professional trader and EU consumer law applies, the seller must respect applicable rights concerning withdrawal, returns, refunds, defective goods and legal guarantees.

Sellers must not use marketplace terms or individual sales conditions to remove consumer rights that cannot legally be excluded.

The applicable seller is responsible for processing valid return, refund, repair, replacement and warranty requests relating to its products.

Product Safety and Compliance

Sellers may only offer products that may lawfully be offered and supplied in the markets to which they sell.

Sellers are responsible for determining and complying with the legal, technical, safety and labelling requirements applicable to their products.

Where EU product safety or compliance rules apply, sellers must provide all information required for an online product offer, including where applicable:

  • Manufacturer name and contact information.
  • Information identifying the product.
  • Product images and identifiers.
  • Required warnings and safety information.
  • Applicable conformity markings or documentation.
  • EU responsible-person information where legally required.
  • Instructions or safety information in the languages required by applicable law.

Sellers must not knowingly list recalled, prohibited, counterfeit, unsafe or otherwise unlawful products.

Product Safety Incidents and Recalls

Sellers must act promptly if they become aware that a product offered through Lux Carbon may be unsafe, prohibited, recalled or otherwise non-compliant.

The seller must take all actions required by applicable law, which may include stopping sales, notifying customers, cooperating with authorities, arranging corrective measures and providing information requested by Lux Carbon.

Lux Carbon may immediately disable or remove a listing where there is a reasonable product safety or legal compliance concern.

Automotive Fitment and Installation

Sellers are responsible for the accuracy of vehicle fitment and compatibility information supplied with their listings.

Where professional installation, modification or additional components are required, this should be communicated clearly to the buyer.

Sellers must not represent a product as road legal, approved or certified unless they have a reasonable basis and any legally required supporting information.

Intellectual Property and Listing Content

Sellers must have the necessary rights or permissions to use product photographs, descriptions, trademarks, logos and other material submitted to Lux Carbon.

Sellers must not upload counterfeit product branding, copied content or intellectual property that they are not authorised to use.

By providing listing content to Lux Carbon, the seller grants Lux Carbon a non-exclusive right to display, format, reproduce and use that content as reasonably necessary to operate, promote and market the marketplace and the seller's listings.

This permission does not transfer ownership of the seller's underlying intellectual property to Lux Carbon.

Customer Data and Privacy

Sellers may receive personal information relating to customers when necessary to respond to inquiries, process transactions, deliver products or provide support.

Sellers may use customer information only for legitimate purposes connected with the transaction or another lawful purpose.

Sellers must comply with applicable privacy and data protection laws and must protect customer information against unauthorized access, disclosure or misuse.

Customer information obtained through Lux Carbon must not be sold, harvested, published or used for unrelated unsolicited marketing in violation of applicable law.

Customer Communication

Sellers are expected to communicate professionally and provide reasonably timely responses to legitimate customer inquiries relating to their products and transactions.

Sellers must not threaten, deceive, harass or deliberately mislead buyers.

Repeated failure to respond to customers, unresolved fulfilment problems or persistent inaccurate information may result in restrictions on the seller account.

Prohibited Seller Activity

Sellers must not use Lux Carbon to:

  • Offer illegal or prohibited products.
  • Offer counterfeit products.
  • Publish intentionally false or misleading listings.
  • Impersonate another person or business.
  • Manipulate reviews, ratings or marketplace activity.
  • Use fraudulent payment requests.
  • Upload malicious code or interfere with marketplace security.
  • Harvest customer information for unlawful purposes.
  • Violate intellectual property rights.
  • Circumvent marketplace restrictions or suspended accounts.
  • Engage in conduct that may expose buyers or Lux Carbon to fraud or unlawful activity.

Marketplace Visibility

Listing products on Lux Carbon does not guarantee any particular search position, number of impressions, inquiries or sales.

Marketplace visibility may be affected by factors including relevance, category, listing quality, product information, availability, marketplace configuration and promotional arrangements.

Lux Carbon may modify marketplace navigation, categories, search functionality and presentation as the platform develops.

Listing Removal and Account Suspension

Lux Carbon may restrict, suspend or remove a product listing where there is a reasonable concern regarding safety, legality, intellectual property, inaccurate information, fraud, policy violations or customer protection.

Lux Carbon may also restrict or suspend a seller account for serious or repeated violations of these Seller Terms or applicable marketplace policies.

Where appropriate and legally required, Lux Carbon may request additional information or allow the seller an opportunity to address the relevant issue.

Serious safety, fraud or legal concerns may require immediate action.

Cooperation with Lux Carbon

Sellers must reasonably cooperate with Lux Carbon when information is required to investigate a customer complaint, product safety issue, legal request, intellectual property complaint or potential marketplace violation.

Sellers remain responsible for the accuracy of documents and information they provide.

Seller Responsibility

Each seller operates as an independent seller and remains responsible for its own business activity.

This includes responsibility for products, pricing, product compliance, customer transactions, taxation, invoicing, fulfilment, shipping, consumer rights, returns, refunds, warranties and after-sales support.

Lux Carbon does not assume those seller obligations merely because a product is displayed or promoted on the marketplace.

Nothing in these Seller Terms excludes any responsibility that Lux Carbon itself cannot lawfully exclude under applicable law.

Changes to Seller Terms

Lux Carbon may update these Seller Terms when reasonably necessary to reflect changes in marketplace functionality, commercial services, legal requirements or marketplace policies.

The latest version will be published on this page. Where required by applicable law or an individual seller agreement, additional notice may be provided.
